Nevada Divorce
Since 1997 we have assisted many couples in filing their Divorces. Nevada is the most friendly State in
the Nation to obtain a divorce.
The basic requirements are:
- The party filing for divorce must be a Nevada resident for at least six weeks before the filing
date.
- A resident witness will need to sign an affidavit stating your residency in Nevada (relatives are
allowed).
- Grounds: You and your spouse must either be incompatible in marriage or have lived separately
and apart for at least one year.
- If you and the other party have children together, each party will also need to attend a ½ day
Court Mandated Divorce Seminar (approx. $40) required by the State of Nevada.
- If one party resides out of State they may qualify for a waiver, or in some cases they may be
required to attend a similar class in their State if one is available.
Joint Petition for Divorce - (Uncontested) - Both parties agree and will sign
- Uncontested process will take about 1 to 2 weeks
- No court appearance required.
- Includes issues of children custody and support, and property and debt.
Complaint for Divorce - (Contested) - One party will not sign or whereabouts are unknown
- Contested process takes about 6 to 12 weeks.
- No Court appearances required if other party defaults or parties settle.
- If other party contests the divorce an Attorney may be consulted. We can refer.
- Includes issues of children custody and support and debt issues.
Residency Information: The State of Nevada has a residency requirement for filing a Nevada divorce.
For Nevada law go to NRS 125.020. If you are currently serving in the military and your military home
state (state of record) is Nevada, you may file for an annulment or divorce in Nevada even if now
residing in another state. Otherwise, you must be a resident of Nevada for six weeks. To prove your
residency, someone else residing in Nevada for at least 6 months must sign an affidavit swearing that
you have resided here for at least 6 consecutive weeks. If your residency has been short-term or is
otherwise questionable, the courts may require additional proof of residency. We do not encourage,
assist or participate in frauds upon the court related to questionable residency.
